These general Terms of Service (the "Agreement") take effect on the date you accept them (the "Effective Date"), between Banglalink Digital Communication Ltd. ("Banglalink", "We", "Our" or "Us") and you and/or the entity you represent ("You," "Your," "Customer"). Banglalink and You are individually referred to as a "Party" and collectively as the "Parties". This Agreement sets the terms for using Banglalink's Wi-Fi service, including any products and services ordered or accessed through it (the "Banglalink Wi-Fi" or "BL Wi-Fi" or "Services").
Please read this Agreement carefully and make sure you understand and accept it. If you do not understand the Agreement, or do not accept any part of it, then you may not use the Service. By using or ordering the Services, you acknowledge and agree to the Agreement and give your express consent to abide and be bound by the same.
Banglalink is a company engaged in providing telecommunications and digital products/services. At the Customer's request, Banglalink agrees to provide the Banglalink Wifi Services on its network, granting the Customer internet access under the terms and conditions outlined herein, which Banglalink may amend from time to time.
"Activation Date" is when Banglalink activates the Banglalink Wi-Fi service, MSISDN, and Monthly Plan for the Customer.
"Activation" is the date Banglalink activates the Banglalink Wi-Fi service for the Customer and notifies them of the activation date. It includes the User's Name, Phone Number, Email Address, Installation Address, etc., and is completed after biometric verification, payment, and monthly plan activation."Device" or "CPE" refers to the Customer Premises Equipment (CPE) provided by Banglalink for the Banglalink Wifi Service.
"Installation Address" is the location where the Customer has requested the Banglalink Wifi service.
"Order Form" means the application form and/or any other form as may be prescribed by Banglalink (whether in digital or physical format) to which these terms and conditions are referred to.
"Relocation" means when the customer relocates his/her Banglalink Wi-Fi device to a different address from that at which Banglalink Wi-Fi service was initially installed/ activated.
"Representative" refers to the authorized individuals acting on behalf of Banglalink to provide the Banglalink Wi-Fi service, including service checks, installation, activation, and after-sales support regarding connectivity.
"Banglalink Wifi Services" or "Services" refers to the Banglalink Wi-Fi service provided by Banglalink, a Fixed Wireless Access (FWA) Internet service that connects to the internet within the defined premises after activation.
"Banglalink Wi-Fi SIM" means the MSISDN provided to customer in CPE device to enjoy the Banglalink Wi-Fi service. SIM will be activated after biometric verification as per current standard process approved by relevant authorities.
"User Account" means an account under the name of the Customer in relation to the Service subscribed by the Customer.
Banglalink Wi-Fi Services: Banglalink provides you with a non-exclusive, non-transferable, and non-assignable right to access and use the Banglalink Wi-Fi Services for the duration of this Agreement, subject to any applicable payments. This right is restricted to use within Bangladesh and is not valid outside the country.
Ownership: You acknowledge and agree that all the software used in connection with the Services contain proprietary and confidential information of Banglalink or the Developers or other third parties that is protected by applicable intellectual property rights and other laws of the land. As between Banglalink and You, all rights, title, and interest in and to all intellectual property rights in the Banglalink Service(s) and documentation are owned exclusively by Banglalink. Except as expressly provided herein, Banglalink does not grant You (and Banglalink expressly reserves for itself and any of its licensors) any rights, express or implied, or ownership in the Banglalink Service(s), information and documentation. Banglalink shall have a royalty-free, worldwide, non-exclusive, transferable, sub-licensable, irrevocable, perpetual right to make, use, sell, offer for sale, import, or otherwise incorporate into Banglalink Service(s) and documentation, any suggestions, enhancements, recommendations, or other feedback provided by You relating to the Service(s) and documentation.
License to Banglalink: You provide Banglalink and its application providers with a non-exclusive, non-transferable, royalty-free license to use your electronic data ("Customer Data") that is processed through the Services, solely for the purpose of delivering those Services to you. For clarity, this license does not grant any rights or permissions to Banglalink to use your data independent of the Service.
1. Licensing, selling, assigning, leasing, distributing, or granting access to the Services to third parties.
2. Creating derivative works or modifying the Services.
3. Disassembling, reverse engineering, or decompiling the Services.
4. Using the Services to develop competing products.
5. Using the Services to provide services to others or run unauthorized applications.
6. Using the Services for any illegal purpose which is prohibited by the laws of the land including but not limited to fraud, hacking, stealing etc.
7. Sending viruses, harmful code, or interfering with the integrity or security of the Services.
8. Removing or modifying copyright or proprietary notices.
9. Reproducing, distributing, or displaying copyrighted material without permission.
10. Violating any laws or regulations of Bangladesh or other jurisdictions.
11. Gaining unauthorized access, altering, disabling, or erasing computer data or software.
12. Accessing the Services through any means other than Banglalink's provided interface.
13. Disrupt the integrity of the Service(s).
14. Temporarily or permanently remove, copy, add, modify, halt or disable any computer data, computer programs or computer software from a computer or computer network without authorization.
15. Cause a computer to malfunction, regardless of how long the malfunction persists.
16. Alter, disable, or erase any computer data, computer programs or computer software without authorization or use them to obtain unauthorized access to the Services.
17. Access the Services by any means other than through the interface provided by Banglalink to access the Services.
(i) Upon receipt of an order form submitted by you, a representative will contact you and confirm provided details such as name, phone number, email address and installation address etc. Banglalink shall verify and confirm availability of the service at your area as stated in the customer order form.
(ii) In the event if the Service is not available in customer area, Banglalink may inform you and your application will be kept in our record so that Banglalink can reach out to you once the Service is made available in your area. However, Banglalink makes no guarantee to you that the Service will become available at that area, and Banglalink shall not be held liable or responsible to make the Service available in that area.
(iii) If Banglalink Wi-Fi service is available at your location, the representative will schedule an appointment to visit your installation address and conduct a service feasibility test. If the test is satisfactory, the representative will inform you that the connection can be provided. They will then collect payment, install the device, complete biometric verification of the Banglalink Wi-Fi SIM, and activate the package.
(iv) If the service feasibility test is unsatisfactory, the representative will inform you, and installation will not proceed. Banglalink reserves the right as to whether to provide the Service at its own discretion.
(v) The representative may need to test the Service strength at various locations within your premises, guided by you, to identify the optimal placement for the CPE device for the best user experience. Banglalink reserves the right as to whether to provide the Service at its own discretion.
(vi) Representative shall fix an appointment date with the Customer for installation of the Service at the installation address, subject to the readiness and availability of all the following basic service and equipment required for the Service:
(a) Customer Premises Equipment (provided by Banglalink only).
(b) Acceptance of the Banglalink Wi-Fi Terms and Conditions.
(c) AC power supply availability for the CPE.
(d) Supporting identity documents / info for SIM biometric verification.
(e) Complete payment.
(f) Any additional requirements as notified by Banglalink.
(vii) Banglalink may reschedule the initially agreed appointment date in case of unavoidable circumstances. We will inform you of any changes.
(viii) If the customer is not ready with the basic equipment as required in clause 4.vi above, Banglalink may at its sole discretion allow you to defer the installation date for a period of fourteen (14) days. If after a period of fourteen (14) days, you are still not ready with the basic equipment, Banglalink may in its absolute discretion cancel your registration for the Service.
(ix) Notwithstanding anything to the contrary in this document, the offering of the CPE device depends on stock availability. Banglalink reserves the right to change or withdraw the CPE or cancel any Customer offer without prior notice.
(x) Banglalink reserves the right to cancel the order if the representative is unable to proceed with activation due to your unavailability.
(i) Once the onsite feasibility is checked and confirmed, the representative will proceed with payment collection, installation, and service activation.
(ii) The representative will collect your payment.
(iii) After payment, the representative will complete your biometric registration process to finalize the SIM purchase according to the standard procedure approved by the relevant authority and Banglalink.
(iv) Following successful payment and biometric registration, the representative will complete the necessary steps for activation and proceed with the installation.
(v) You must not relocate the Banglalink Wi-Fi device without notifying Banglalink. Banglalink will not be responsible for maintaining service or connectivity if the device is moved from its original installation location. Additionally, if you relocate the device, Banglalink reserves the right to remove the package from your profile as well as restrict Banglalink Wi-Fi Services.
(vi) You must ensure the security of your network and shall be responsible for the illegal usage of your network by other individuals.
(i) The monthly Wi-Fi plan will be activated with the auto-renewal feature set to "ON" by default through Banglalink representative. The plan will auto-renew as long as you maintain sufficient mobile balance. You can enable or disable the auto-renewal feature through your Banglalink Wi-Fi User Account.
(ii) Notifications regarding your plan will be sent according to the plan's specifications.
(iii) If renewal fails due to insufficient balance, you will be unable to access Banglalink Wi-Fi service until the plan is successfully renewed.
(iv) Banglalink reserves the right to amend the monthly plan from time to time at its discretion or to withdraw the monthly data plans at any time without assigning reasons for such withdrawal and migrate to another plan or promotional package as Banglalink deems fit.
(v) The unlimited internet quota is subject to a reduced speed policy and volume caps. You may continue to use the internet at a reduced speed until the validity of the current plan expires.
(vi) Download and upload speeds may vary depending on peak or off-peak hours in your area. To prevent abuse, Banglalink reserves the right to impose volume usage caps and a Fair Usage Policy (FUP) at any time, notifying existing Customers and publishing updates on the Banglalink Wi-Fi website for new customers.
(vii) As the plan is unlimited, any remaining data volume does not carry over to the next month.
(viii) You can monitor your data plan balance through your Banglalink Wi-Fi User Account.
(ix) You can upgrade or downgrade your plan based on the options available in your Banglalink Wi-Fi User Account.
(x) This plan/package will not work if you remove the SIM card and insert it into another device.
(i) VAS/OTT free subscriptions are included with the Banglalink Wi-Fi monthly plan. Please note that VAS/OTT services may change or be discontinued at any time without prior notice.
(ii) Banglalink may discontinue any or all the free OTT / VAS services at any given time without any liability or prior notice.
(iii) VAS/OTT services can be configured on devices such as smart TVs, smartphones, and laptops. Banglalink is not responsible for any compatibility issues with your devices.
(iv) Banglalink will not be liable for any issues, service limitations, or functionality related to free VAS/OTT services provided through apps or websites.
(i) The charges for the service shall be at the applicable rate indicated in the "Order Form" which is confirmed during activation. The required charges will be prescribed and informed to you by Banglalink from time to time.
(ii) Charges will include VAT, SD, and SC in accordance with standard practices approved by relevant authorities and Banglalink's policies.
(iii) You need to maintain sufficient balance to ensure successful renewal of monthly Wi-Fi plan by the 30th day of monthly plan activation.
(iv) If you do not have sufficient balance on the renewal date, the monthly plan will not be renewed, and you will be unable to access Banglalink Wi-Fi service.
(v) If your monthly plan has expired, then you can recharge and activate as per standard process as mentioned in this document.
(vi) Banglalink reserves the right to change the prices and offers at any time at its discretion. Such changes will be communicated to you.
(i) Payment will be collected by a Banglalink representative during the activation process for CPE, Banglalink Wi-Fi SIM and dedicated pack as a bundle.
(ii) Discounts may be offered by Banglalink based on promotional campaigns. These offers can be modified or canceled without prior notice.
(iii) Customers must make advance payments to activate and maintain the Services active for the specified validity period.
(iv) At the end of validity, all free benefits such as OTT subscription or any other benefit will be forfeited.
(v) Upon expiration of the validity period, you will need to pay for the desired monthly plan to reactivate Banglalink Wi-Fi services.
(vi) Any overpayment made will be credited to your main account balance and can be used for future renewals.
(vii) Banglalink may at any time and for a period to be solely determined by Banglalink, offer any rewards, discounts, or other benefits ("Benefits") to its customers for the subscription of the Service / Value Added Service / Add-Ons / Sales Campaign. Further, Banglalink has the right to discontinue or change the benefits or replace the terms of such benefits at any time.
(i) Refunds for the CPE device is only available if the device is undamaged and there is a persistent Service issue validated by Banglalink under the following conditions:
(a) The Service was activated in an area where Banglalink Wi-Fi Service is available and not used anywhere except the installation address after activation.
(b) The Service was not relocated without prior notification and approval from a Banglalink representative.
(c) The CPE must comply with all warranty conditions and should not have been damaged internally or externally by the Customer.
(ii) Refunds are not applicable for the Banglalink Wi-Fi SIM. Banglalink reserves the right to deregister the SIM and follow the recycling process as per regulatory requirements.
(iii) Upon successful validation, the refund amount will be transferred to the Customer's verified bank account within 60 working days from the confirmation of refund eligibility by a Banglalink representative via email.
(iv) Banglalink reserves the right to deny refund requests if the Customer fails to provide the necessary documentation and proof of the Service issue.
(v) Banglalink is not liable for any claims, losses, or damages resulting from improper use or installation of the CPE and any change of mind by the Customer.
(vi) CPEs sold at a discounted price as part of a promotional campaign are not eligible for any refund or return.
(vii) You may relocate your Banglalink Wi-Fi service to any location where the service is available. However, you must inform a Banglalink representative at least 20 days prior to the relocation to allow for verification and arrangements.
(viii) Only service personnel authorized by Banglalink in this regard shall be allowed to inspect and rectify the CPE in case of any malfunction.
(i) You are responsible for safeguarding your Banglalink Wifi CPE and SIM.
(ii) You must maintain the confidentiality of any passwords and should not disclose them to others.
(iii) You must notify Banglalink immediately if your SIM is stolen or lost. Banglalink is not liable for replacing a SIM or CPE that is lost, stolen, or damaged intentionally.
(iv) If your Banglalink Wi-Fi SIM is lost, stolen, or damaged, you must follow Banglalink's SIM replacement process. Any associated replacement costs will be carried by you.
(v) You undertake and agree to take necessary precautions to prevent any spam or malicious traffic from being generated from your end. If spam or malicious activity is detected, Banglalink reserves the right to lock, suspend, or terminate the affected website in accordance with regulatory guidelines.
(vi) Banglalink will test the CPE prior to installation, and you are responsible for checking its functionality at the time of installation at your premises. After installation, Banglalink and its affiliates are not liable for defects or faults not covered by the manufacturer's warranty. Banglalink is not responsible for any damage or defects resulting from misuse, intentional damage, accidents, or force majeure events.
(vii) You must not move or transfer the CPE. Failure to comply with these terms and conditions may result in Banglalink assuming no liability for related issues.
The internet speed for your Banglalink Wi-Fi service may vary but will remain within the maximum threshold of your selected package. To ensure optimal service, it is important to keep the CPE in the same location as installed by the representative. The Customer acknowledges that internet speed can be affected by the following factors:
(i) The location of apps or websites, which may result in slower speeds for some international web sites.
(ii) The capacity of the web server being accessed.
(iii) Network congestion due to maintenance, outages, or natural disasters.
(iv) The operating system configuration, which can impact internet performance.

By agreeing to these terms and conditions, you agree to indemnify Banglalink from and against all claims, costs, damages, losses, liabilities and expenses (including legal charges and costs) resulting from or in association with: (a) violation or infringement of any of the terms of this Agreement and (b) your and any other individual’s usage/misuse of the Services on your network.
(i) You expressly understand and agree that in no event shall Banglalink be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits or income, goodwill use data or other intangible losses (even if the indemnified parties have been advised of the possibility of such damages under contract, warranty, negligence, strict liability or any other theory), resulting from:
(a) the disruption, use or the inability to use the service(s), the Banglalink or any content for any reason;
(b) any third party claims that the use by you of the Banglalink service or the content violates any intellectual property right;
(c) any action taken by Banglalink as part of an investigation into a suspected violation of the terms or as a result of its conclusion that you have violated, or
(d) any other matters relating to the Service(s), or the content.
(ii) You specifically acknowledge that Banglalink is not liable for the defamatory, offensive or illegal conduct of third parties and that the risk of injury from the foregoing rests entirely with you. Further, Banglalink shall have no liability to you for any content downloaded from the Service(s).
(iii) You agree that the aggregate liability to you for all claims under contract, warranty, negligence, strict liability, or other theory arising under these terms or from any of Banglalink or affiliate policies or the use of the Banglalink service, is limited to BDT 3000 (Taka Three thousand only).
(i) Banglalink reserves the right to amend, modify or change the terms and conditions of this Agreement, or any part thereof, or may impose new conditions for the use of the services at anytime. Except as otherwise stated herein, any modification to this Agreement shall be effective immediately after it initially is posted on the ampacity. Use of the service after any such modification will be conclusively deemed acceptance of such modification.
(ii) Notwithstanding anything contained herein, Banglalink reserves the right to change, vary, add, substitute, or withdraw this Banglalink service or any other related services. Banglalink will also have the right to change /vary/increase /reduce the tariff charges, prices, validity period, product/service feature and any other offers etc. at any time in its sole discretion for any reason subject to official notification of such offers prior to giving effect to such changes.

You acknowledge and agree that your use of the services is subject to our privacy policy. By using the services, you agree that Banglalink may use such data in accordance with Banglalink's privacy policy, available at https://banglalink.net/en/legal.
Your use of application provider's services may also be subject to the privacy policies of the application provider.
If Banglalink determines you have breached this Agreement, it may suspend or terminate your access to the Services without refund and pursue legal action. You could also face civil or criminal penalties. Banglalink shall have the right to temporarily suspend the Services, in whole or in parts, for network repair, maintenance, or due to circumstances beyond Banglalink's control.
Banglalink may disconnect or suspend Services without notice if you breach terms.
Banglalink shall have the right to disconnect, suspend or bar the services for any violation of any law of the land or giving false information on the subscription form and/or for changes in the given information, which is not informed to Banglalink.
Banglalink may terminate the Agreement or the Service(s) or your account immediately without any notice to you. You may terminate this Agreement and the Services or deactivate your account after paying any dues you owe to Banglalink.
This Agreement shall be governed by the laws of Bangladesh. In case of any dispute by the Customer in relation to this Agreement, the Customer shall notify Banglalink in writing and provide at least 30 calendar days for resolution of the dispute. Banglalink shall try its best to resolve any issues within such timeline. If mutual resolution is not possible, the decision of Banglalink will be final and binding on you.
